# Terms and Conditions
These Terms and Conditions ("Terms") govern the sale of products by Nexapep Ltd ("Nexapep", "we", "us", "our") through nexapep.co.uk. By placing an order, you ("the customer", "you") agree to be bound by these Terms.
### 1. Company information
Nexapep Ltd is a company registered in England and Wales. Registered office and contact details are available on request at hello@nexapep.co.uk. Our UAE operations are conducted through a separate entity (Nexapep UAE) with its own commercial registration.
### 2. Products
All products supplied by Nexapep are research peptides and laboratory consumables classified as Research Use Only (RUO). Products are not medicines, dietary supplements, or any item intended for human or veterinary consumption. Products are not approved by the MHRA, FDA, EMA, or any equivalent regulatory body for human use.
Full product specifications, including molecular formula, molecular weight, CAS number, and storage conditions, are listed on each product page. A Certificate of Analysis is included with every order. Additional batch documentation is available on request.
### 3. Eligibility to purchase
By placing an order you confirm that:
- You are 18 years of age or older.
- You are purchasing for legitimate laboratory research purposes.
- You are qualified or supervised by a qualified researcher to handle research peptides appropriately.
- You will not administer products to humans or animals outside of approved research protocols.
- You will comply with all applicable laws and regulations in your jurisdiction relating to the purchase, handling, and disposal of research peptides.
We reserve the right to refuse or cancel any order at our sole discretion, including where we have reasonable grounds to believe these conditions are not met.
### 4. Pricing and payment
All prices are displayed in the currency of the site you are ordering from (GBP for nexapep.co.uk, AED for nexapep.ae). Prices include applicable taxes where required.
We accept the payment methods displayed at checkout. Payment is required in full at the time of order. Orders are not dispatched until payment is confirmed.
We reserve the right to amend prices at any time. The price applicable to your order is the price displayed at the time you place the order.
### 5. Orders and acceptance
Submission of an order constitutes an offer to purchase. A contract is formed only when we confirm acceptance of your order by email and dispatch the goods. We reserve the right to reject any order without giving reason.
If a product is listed at an incorrect price due to typographical or technical error, we reserve the right to cancel the order and refund any payment received, even after order confirmation.
### 6. Shipping and delivery
Shipping terms, dispatch times, and delivery responsibilities are set out in our Shipping Policy, which forms part of these Terms.
### 7. Returns and refunds
**No returns or refunds on opened or used products.** Due to the nature of research peptides — including sterility requirements, chain-of-custody integrity, temperature stability, and the impossibility of verifying handling conditions once a product has left our facility — we operate a strict no-returns policy on all opened, used, or partially used items. This is consistent with standard practice across the research chemical and laboratory consumables industry.
By placing an order, you acknowledge that you have reviewed the product specifications, Certificate of Analysis details, and storage requirements before purchase, and that the product is suitable for your research purposes.
**Returns are only accepted in the following limited circumstances:**
- **Faulty or mislabelled product** — If a product is confirmed by our quality team to be faulty, mislabelled, or to deviate from the specifications stated on its Certificate of Analysis, we will issue a full refund or replacement. The customer must contact hello@nexapep.co.uk within 7 days of receipt with photographs of the issue and the batch number from the vial label.
- **Damaged in transit** — If a shipment arrives with visible external damage to the packaging, the customer must photograph the parcel before opening it and contact hello@nexapep.co.uk within 48 hours of receipt. Damage discovered after the package has been opened cannot be processed as a transit damage claim.
- **Wrong item shipped** — If we ship an incorrect item, contact us within 7 days of receipt and we will arrange a replacement at no additional cost. The incorrect item must remain unopened and in its original packaging.
**The following do not qualify for refund or return under any circumstances:**
- Products that have been opened, reconstituted, or partially used
- Products stored or handled outside the conditions stated on the product page or Certificate of Analysis
- Customer change of mind, ordering error, or change of research direction
- Compounds that do not perform as the customer hoped — performance in any specific research application is the responsibility of the researcher and is not warranted by Nexapep
- Delays caused by customs, courier services, or addresses provided incorrectly by the customer
- Refusal to receive a shipment
**Process for legitimate claims:** Email hello@nexapep.co.uk with your order number, batch number, photographs, and a description of the issue. Do not return any item without prior written authorisation — unauthorised returns will not be processed and the item will not be returned to you.
**Refunds, where issued, are processed to the original payment method within 5 business days of approval. Original shipping costs are non-refundable except where the return is due to our verified error.**
### 7a. Statutory rights — UK Consumer Contracts Regulations 2013
Under the UK Consumer Contracts Regulations 2013, consumers may have the right to cancel a distance contract within 14 days of receipt. **However, this right does not apply to:**
- Goods that have been unsealed (peptide vials, BAC water vials, and similar consumables are considered unsealed once removed from their tamper-evident outer packaging due to sterility implications under Regulation 28(3)(b))
- Goods made to the consumer's specifications or clearly personalised
- Goods liable to deteriorate or expire rapidly
These exemptions apply to substantially all products supplied by Nexapep due to their nature. Unopened products in their original tamper-evident outer packaging may be returned within 14 days of receipt under these regulations, at the customer's expense, by contacting hello@nexapep.co.uk for return authorisation.
Nothing in this clause limits your statutory rights under the Consumer Rights Act 2015 in respect of faulty or misdescribed goods.
### 8. Cancellation rights
Under the UK Consumer Contracts Regulations 2013, you may cancel a distance contract within 14 days of receipt of the goods without giving a reason. This right does not apply to products that have been opened, used, or are subject to deterioration. To exercise this right, contact hello@nexapep.co.uk within the cancellation period.
### 9. Research Use Only — no medical or therapeutic use
You acknowledge that all products are sold strictly for laboratory research use and not for human or veterinary use. Nexapep makes no warranty, express or implied, that any product is suitable, safe, or appropriate for any use beyond laboratory research. Full terms are set out in our Disclaimer, which forms part of these Terms.
### 10. Intellectual property
All content on nexapep.co.uk — including text, images, graphics, logos, and branding — is the property of Nexapep Ltd and is protected by UK and international copyright and trade mark law. You may not reproduce, distribute, or use any content without our prior written permission.
### 11. Limitation of liability
To the fullest extent permitted by law, Nexapep's liability for any claim arising from the supply of products is limited to the price paid for the product giving rise to the claim. We accept no liability for any indirect, consequential, or special losses, including loss of profit, loss of data, or business interruption.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded by law.
### 12. Force majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, government action, courier or supplier failures, internet outages, or public health emergencies.
### 13. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your purchase shall be subject to the exclusive jurisdiction of the courts of England and Wales.
### 14. Changes to these Terms
We may amend these Terms from time to time. The version applicable to your order is the version in force at the time of your order. Continued use of the site after changes constitutes acceptance of the updated Terms.
### 15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
